Driving without insurance in Florida

In Florida the lapse does the damage, not the ticket: a reported cancellation suspends license and registration, and getting them back costs $150 to $500 and two years of proof.

What Florida requires, and of whom

Florida's compulsory insurance has two parts. Every owner or operator of a registered motor vehicle must be able to respond in damages of $10,000 for property damage in any one crash, and every owner or registrant must keep personal injury protection security in force “continuously throughout the registration or licensing period.”

Fla. Stat. sec. 324.022 · 2025 Florida Statutes

Every owner or operator of a registered motor vehicle maintains the ability to respond in damages of $10,000 for property damage in any one crash. For this section “motor vehicle” means a self-propelled vehicle “that has four or more wheels”, excluding mobile homes, school buses and some transit and for-hire vehicles.

The property damage section defines its vehicles narrowly: a self-propelled vehicle “that has four or more wheels” and is required to be licensed for the highway, plus trailers. Nonresidents are caught too: a vehicle physically present in Florida for more than 90 of the preceding 365 days must carry the same security for as long as it stays.

The stop: a nonmoving infraction

A driver must have proof of the required security in their immediate possession while driving, on paper or electronically, and show it on an officer's demand. Accepted proof includes the department's uniform paper or electronic format, the policy itself, a binder or a certificate of insurance. Showing a phone does not consent to the officer looking at anything else on it, and the statute adds that a driver who hands over a device takes on the risk of any damage to it.

Fla. Stat. sec. 316.646 · 2025 Florida Statutes

Drivers carry proof of PIP and property damage security. An owner-driver who cannot show it commits a nonmoving traffic infraction; if they fail to furnish proof by the court date that security was in effect, the court on conviction has the registration and license suspended, reinstated only under sec. 324.0221. A non-owner driver commits the infraction only. Knowingly presenting proof of lapsed insurance is a first-degree misdemeanor.

If you own the car

An owner or registrant who cannot show proof commits a nonmoving traffic infraction and must furnish proof. The deadline is the court date: if the owner fails “to furnish proof at or before the scheduled court appearance date that security was in effect at the time of the violation,” the court on conviction has the registration and license suspended. If the court does not order it, the department does on receiving notice of the conviction.

If you do not

A driver who is not the owner or registrant commits the same nonmoving infraction, but the suspension provision is written for owners.

Lying about it

Presenting proof of insurance that you know is no longer in force is a first-degree misdemeanor — a different and more serious offense than having none.

The lapse itself: suspension without a stop

Florida does not need a traffic stop. Insurers must report cancellations and non-renewals of PIP and property damage cover to the department within 10 days, and the department, after notice and an opportunity to be heard, suspends the registration and license of an owner whose records show no required security, or whose insurer reports the security canceled.

Fla. Stat. sec. 324.0221(2)-(3) · 2025 Florida Statutes

The department suspends the registration and license of an owner without required PIP and property damage security. Reinstatement costs $150 the first time, $250 the second and $500 for each later reinstatement within three years of the first, and proof of coverage must then be maintained for two years.

How the department knows

The reporting runs in both directions. An insurer reports every cancellation or non-renewal of PIP or property damage cover within 10 days of processing it, and it also reports a new policy issued to someone it did not insure earlier that calendar year, within 10 days. The department uses those records to measure compliance and to act on lapses. A failure by an insurer to report properly is a violation of the Florida Insurance Code — and it is also why a driver who switched insurers on time can still receive a lapse notice, if the new policy's report has not arrived. The answer to that notice is proof that coverage was continuous.

What reinstatement costs

Reinstating costs $150 the first time, $250 the second, and $500 for each later reinstatement within three years of the first. The person must also obtain coverage meeting the statutory amounts and present proof on the department's form — and that proof “shall be maintained for 2 years.” Insurers are required to warn policyholders, in writing, that a cancellation will be reported and what reinstatement costs.

An accident while uninsured

Florida's no-fault system protects insured owners from some lawsuits. An owner without PIP security at the time of an accident loses that protection: they “shall have no immunity from tort liability, but shall be personally liable for the payment of benefits” that a PIP insurer would otherwise have paid.

Fla. Stat. sec. 627.733(4) · 2025 Florida Statutes

Owners keep PIP security “continuously throughout the registration or licensing period”; an owner without it at the time of an accident “shall have no immunity from tort liability, but shall be personally liable for the payment of benefits” under sec. 627.736. Nonresidents whose vehicles are in Florida more than 90 of 365 days must insure too.

When the filing becomes an FR-44

A lapse leads to proof of ordinary coverage. A DUI leads somewhere else: Florida's FR-44, at limits far above the ordinary minimum, for three years. FR-44 vs SR-22 has the figures.

Exemptions

A member of the armed forces called to active duty outside the United States in an emergency is exempt while on that duty, provided the vehicle is not driven. The insurer must cancel or suspend the coverage and return unearned premium on written request, and the department may not suspend during the exemption. The owner must notify the department before and at the end of it.

Where this leaves you

For most Florida drivers the cost of a lapse is the reinstatement fee and two years of proof, not a fine. If you were stopped, the answer is proof at or before your court date. Florida license reinstatement covers the other suspension reasons. The Florida page covers the filing, and driving without insurance compares Florida with nine other states.
