What Mississippi proof has to cover

Mississippi's Motor Vehicle Safety-Responsibility chapter is Chapter 15 of Title 63. It defines proof of financial responsibility as ability to respond in damages, for accidents after the proof takes effect, of $25,000 per person / $50,000 per accident / $25,000 property damage — 25/50/25. The authority is Miss. Code Ann. sec. 63-15-3(j).

That is $25,000 for injury to or death of one person, $50,000 for two or more people in one accident, and $25,000 for property of others. The same chapter requires every motor vehicle operated in the state to carry a liability policy at those limits, and the insurer to issue an insurance card for each vehicle, on paper or electronically.

The family-transfer rule

This is the section that sets Mississippi apart. A person whose license or registration has been suspended or canceled under the chapter may not transfer title to a vehicle they own to a member of their immediate family until they have furnished proof of financial responsibility and the department has approved it.

The definition of family is wide. It includes anyone related to the person “by blood or marriage within the third degree computed according to the civil law,” and anyone, related or not, living in the same household. Moving the car into a spouse's, sibling's, parent's, adult child's or roommate's name does not work around the requirement.

A conviction reaches every registration

When the department suspends or revokes a license on a conviction or bail forfeiture, it also suspends the registration of every vehicle licensed in the person's name, unless proof is given and maintained for all of them. The license and registrations then stay suspended until the person is permitted to drive again and gives proof. An unlicensed person convicted of an offense that would require suspension, or of driving without a license, cannot be issued one until they give proof.

Three years, in all cases

The duration section opens: “In all cases, under this chapter, in which a person is required to furnish proof of financial responsibility, he shall maintain such proof for a period of three years.” Miss. Code Ann. sec. 63-15-61. Release then follows after three years from the date proof was required, if the preceding three years are clean of a conviction or bail forfeiture that would require suspension; or on death, permanent incapacity, or surrender of the license. Bonds and deposits are held while a damages action is pending or a judgment unpaid.

Ten days' notice, by mail or electronically

Certified insurance may not end until at least ten days after a notice of cancellation is “placed in the mail, or transmitted by electronic means, to the department.” The electronic option was added effective January 1, 2017. A later certified policy ends the earlier one on its own effective date.

An owner's proof for others

The chapter also lets the department accept proof given by an owner for someone else who drives that owner's vehicle, in place of the other person's own proof.
